1. Agreement and Definitions

1.1 Agreement Overview

Welcome to our Terms of Service. This document forms a legal agreement ("Agreement") between you ("User") and CookMark ("Provider") governing the use of our mobile application. By using the application, you accept these terms.

1.2 Terms and Definitions

• Effective Date: The initiation date of this Agreement.
• User Content: Recipe links, screenshots, photos, notes, and meal-plan data created or uploaded within the application by the User.
• Mobile Application: The "CookMark" software designed for your mobile device.
• Services: AI-powered recipe extraction, grocery list generation, planning, and related features.
• Subscription: Grants full access to services with an automatic renewal option.
• Subscription Fees: Fees associated with the subscription.
• Free Services: Services provided at no cost with limited features.

2. Services

The Provider grants you a license to use the application for personal use. Services include recipe capture, AI-powered ingredient extraction, meal planning, grocery organization, and in-app purchases. Free Services are available with limited features, and the Provider may impose technical restrictions and alter functionality.

3. Authorization

The Provider authorizes your access to and use of the application. Users must register, provide necessary information, and acknowledge that the Provider processes personal data in accordance with the Privacy Policy. Users are responsible for account security.

4. User Content

Users retain rights to User Content and grant the Provider a license to use, store, and process such content for app functionality. Users are responsible for the legality of User Content, and the Provider is not liable for the loss of such content.

5. User Restrictions

Users must use the application within legal and contractual limits, refraining from copying, revealing, or creating unauthorized software. The application must not be used for illegal or harmful content.

6. Provider's and User's Obligations

The Provider ensures services are performed with reasonable skill. Users pay Subscription Fees and ensure account security. Users must also comply with applicable laws and regulations.

7. Term and Termination

These terms commence on the Effective Date. Termination may occur at the discretion of either User or Provider for various reasons, and upon termination, access to services ceases.

8. Fees; Payment Terms

Certain services require payment. Subscription Fees are paid according to selected plans, and purchased content and in-app purchases are subject to Provider management. All payments are processed through Apple App Store and other supported storefronts.

9. Liability

The application is provided on an "as is" basis, with the Provider disclaiming warranties. The Provider is not responsible for User Content or application availability. Users indemnify the Provider for claims and damages, and the Provider's liability is limited.

10. Governing Law and Jurisdiction

These terms and conditions are governed by the laws of the jurisdiction in which CookMark is registered.

11. Final Provisions

The relationship is that of independent contractors. Information processing is governed by the Privacy Policy. The Provider reserves the right to interrupt services for maintenance. These terms constitute the entire agreement.
